Anyone here selling in daytona beach fl area? Fri, 10/31/08 10:23 PM (permalink)
Planning to move soon to New Smyrna, Daytona, Ormond beach area and begin selling after first of year. We were wondering if anyone on here is selling in that area. Would appreciate any input or opinions.

Thanks

    Hey

You cannot sell from a cart anywhere in the area, trust me I tried. The home depot there is one of the few that does not have a cart in front of it as well.

This is a repeat of my post from a few days ago. Port Orange is just south of Daytona, between Daytona and New Smyrna Beach.

Just for the hell of it I checked with the Business & Permitting Department at City Hall here in Port Orange, FL, and was told they do not allow any type of mobile venders at all. I asked to see the Code prohibiting venders, the lady behind the desk went for the Department Manager. He dug out the Code Book and showed me the code. After reading it I pointed out that it bans peddlers but does not use the word venders. It goes on to define peddlers as moving from one location to another during the course of business. I told him that a Hot Dog cart would not move from location to location but would be at the same location each day and as such did not fit the definition of peddler. He responded that it would be moved to that location each day to which I laughed out loud. Even he had to grin at that lame response.

Now comes the good part. My 11 year old Grandson plays on a little league baseball team at one of several City owned and maintained baseball fields. I asked him how the hot dog venders there obtained their permits. He looked at the desk lady and asked if there were venders at the baseball fields, HUH. When she told him there were he said maybe they do not have permits to operate, another big laugh out loud from me. SHE then said they submit bids for contracts each year. HELLO, if peddlers/vendors are banned how do they get a permit? We do not know, perhaps the Parks and Recreation Department issues them a permit.

At that point I thanked them for their help and left while smiling at them.

We went to the Volusia County permitting dept a few weeks ago and watched them recoil in horror when they thought I was talking about a cart.

We are going to be selling from a step van we have built to state legal specs. Seems that it will be permissable with a bunch of restrictions as there is no actual rulings against this sort of vehicle, and all the hoops we have already jumped thru, they reluctantly admitted this will have to be permissable.

Unlike a trailer or a cart a truck is instantly movable. There are certain areas we wont be able to go. We will be living in Deltona and selling in Daytona. Have bought a small closed restauarant in Deltona thats been closed as its in a real bad location for a restauarant and was amazingly cheap because it has sat empty so often and for so long. The owner was just tired of all the hassles of having a new tenant every couple months. We could not have bought the equipment for what we paid for the whole works.

This will be our commissary and base. This fact did away with a nice portion of the restrictions. Made us look that much more serious. Just need to bring it up to snuff and open as a commercial kitchen rather that a restaurant. Good sized parking lot that will be fenced in. This will allow us to prepare most anything we may want to sell.

For some reason it seems more and more places are very much against carts. We had to show them our state permits and initial health dept clearance from our present HD. Licenses, photos, diagrams, proposed menu, etc. For some reason they also had to do a thorough background check and CREDIT check on us. Coming from our former business, the background check was 100%. Given that we just sold that same successful business our credit rating couldnt have been better. We also had to note that we would not be selling any Mexican food (is this some sort of racism?). With things the way they are today you would think cities/counties would be overjoyed to let people start a business with out so much hassle to try to get them off the unemployment rolls.

We were wondering if there was anyone in the area that might be looking for a commissary and could take advantage of our situation. The location is secure just really hidden down a side street and will be able to pass inspection with a little work. Just a thought.

The OP has not posted here in over 2 years. But there are many doggers here from FL.
You might want to ask your questions over there.
