This is a repeat of my post from a few days ago. Port Orange is just south of Daytona, between Daytona and New Smyrna Beach.
Just for the hell of it I checked with the Business & Permitting Department at City Hall here in Port Orange, FL, and was told they do not allow any type of mobile venders at all. I asked to see the Code prohibiting venders, the lady behind the desk went for the Department Manager. He dug out the Code Book and showed me the code. After reading it I pointed out that it bans peddlers but does not use the word venders. It goes on to define peddlers as moving from one location to another during the course of business. I told him that a Hot Dog cart would not move from location to location but would be at the same location each day and as such did not fit the definition of peddler. He responded that it would be moved to that location each day to which I laughed out loud. Even he had to grin at that lame response.
Now comes the good part. My 11 year old Grandson plays on a little league baseball team at one of several City owned and maintained baseball fields. I asked him how the hot dog venders there obtained their permits. He looked at the desk lady and asked if there were venders at the baseball fields,
HUH. When she told him there were he said maybe they do not have permits to operate, another big laugh out loud from me.
SHE then said they submit bids for contracts each year.
HELLO, if peddlers/vendors are banned how do they get a permit? We do not know, perhaps the Parks and Recreation Department issues them a permit.
At that point I thanked them for their help and left while smiling at them.
