i have a question, if someone gets food poisoning, would the hotdog cart business be liable or the restaurant that supplies the food for the cart?

Most likely you. The cart owner. Since its our job to insure we don't sell spoiled food and keep them out of the " danger zone "

A good lawyer would sue everyone involved and let the judge/jury figure it out. That's why the insurance industry exists. Make sure that you are insured for product liability.

And are gonna go for those with deep pockets. Don't advertise you have insurance, just prove it to those who need to know. Most of all, don't poison anyone.

I don't know about other places, but here our general liability insurance policy includes a clause that they do not cover food poisoning.

if something does happen to you and you know you stuff is ok. food poisoning needs about 3 days to show signs, so if someone taks 3 bites of you food and ralphs, it's 99.9% it's not your stuff. course that dont make a customer feel much better thou. and it could even be a stomach flu too. those are fun, even smelling or thinking about food will make you blow chunks.

If one person wants to blame food poisoning on you, how do they prove it was you? If ten people complain, you've got a problem.

Insurance that doesn't cover food poisoning? For a restaurant/food cart? That sounds odd....I better double check my coverage. Having said that, I would think you'd have to work hard to get food poisoning from a hot dog cart.
