There's a big difference between hosting, originating and receiving. The host of a website would be indemnified by the posting of user content so long as they are given the opportunity to remove the material via a Cease and Desist demand letter. If they don't take action or respond, they are wide open to a civil demand as I understand it. In the case of P2P networks it would be the same. The originator and the receiver have broken the law, not the host. Settlement offers are in the $1500-$3500 range; about the same cost to defend, for a lot less hassle. Just enough to hurt, without crippling. You can pay, and appear in court, and maybe lose anyhow; or you can pay.
